SANTA ANA – A driver who was under the influence of drugs when he hit and killed a 24-year-old Santa Ana man and then left the scene was sentenced to 15 years in prison, authorities said Wednesday (February 22, 2017.) Marcello Bisarello was sitting on the sidewalk at McFadden Avenue and Cedar Street in Santa Ana around 1 p.m. in November 2015 when Ramon Horta, 56, slowly veered his van onto the sidewalk and ran over Bisarello, the Orange County District Attorney’s Office said. Prosecutors said Horta tapped his brakes and looked out his rear window before continuing along McFadden at the same speed. A good Samaritan called 911 and then followed Horta and forced him to pull over about a half-mile from the scene. On Tuesday, Horta pleaded guilty to one felony count of vehicular manslaughter while intoxicated, prosecutors said. At the time of the crash, he was driving on a suspended license for a previous DUI conviction, according to court records. Horta was initially charged with second-degree murder but the count was dismissed as part of a plea agreement.
In 2001, Horta pleaded guilty to possession of a controlled substance with intent to sell and driving on a suspended license and was sentenced to nine months in jail, according to court records. In 2005, he was convicted of felony possession of a controlled substance and was sentenced to 16 months in prison. He was again convicted and sentenced to two years in prison in 2008 for possession of a controlled substance with intent to sell.
Lori Haley, a spokeswoman for the Department of Homeland Security, said Horta had been deported from the U.S. multiple times, most recently in 2012.
